City Sues 11 Vape Wholesalers For Selling Illegal Flavored Vapes

Over the last two years, defendants have sold millions of dollars worth of flavored disposable e cigarettes to restrain stores throughout the city and directly to consumers through the internet, according to Sylvia Hinds-Radix, city’s corporation counsel.

Mayor Eric Adams and other officials announced a newly filed lawsuit on Thursday against 11 vape wholesalers who they say are selling illegal flavored e-cigarettes. The selling of flavored vapes has been banned since 2020, but their use — especially among children — is skyrocketing, the mayor said.

"We will not allow the greedy, harmful and openly illegal behavior to continue," Adams said at a City Hall announcement Thursday. The lawsuit, filed in Manhattan Supreme Court, is an effort by the city to fight the growing use of e-cigarettes by kids, Adams said. "Flavored e-cigarettes are the gateway to nicotine addiction. 81 percent of first time users age ages 12 to 17 started with flavored products."

“Nicotine addiction among middle and high school youth is exploding thanks in no small part to the actions of businesses like these 11 defendants," the Mayor said.

Last year, the city sued four vape vendors in federal court for millions of dollars in damages.

According to the mayor and the filed lawsuit, City investigators uncovered invoices from retail smoke shops selling flavored vapes, and were also able to directly order the illegal products from the wholesalers to city addresses. The suit seeks to block the businesses from selling the illegal products and for unspecified damages and penalties.

"City investigations reveal that over the last two years, defendants have sold millions of dollars worth of flavored disposable e cigarettes to restrain stores throughout the city and directly to consumers in the city through the internet and violations of the laws," said Sylvia Hinds-Radix, the city’s corporation counsel. "These illegal sales are ongoing and need to be prevented."

Such flavored vape products have been banned by the Food and Drug Administration, the state of New York and the city itself in recent years amid fears that they entice youngsters to use them.

Dorian Furman, co-founder of Parents Against Vaping e cigarettes said the suit was a good "first step." "There's so much more that needs to be done. Thousands of these stores around the city are selling these dangerous and unregulated flavored nicotine vaping products," she said. "They're illegal." "And yet," Furman said, "these distributors continue to supply these vape products to smoke shops around the city."
